RESERVATION: A signed contract and 50% deposit are required to reserve the specified coverage/booking. The Booking Fee will be subtracted from the total cost of the Package/Cost.

Please Note: Dates are reserved on a first-come basis and may fill quickly. Deposit will be returned if specified coverage or date is no longer available.

DEPOSITS: In the event of a postponement or cancellation, the security deposit paid is non-refundable if notice is received less than 30-days before event date. Fifty percent (50%) of the deposit will be refunded if less than 60-days (but more than 30-days) of notice is given.

PRE-EVENT CONSULTATION: The parties agree to a pre-event (phone) consultation approximately one week before the event date in order to finalize the actual shooting times, locations, and CLIENT’S request list for specific photographs.

EXCLUSIVE PHOTOGRAPHER: Rixile Photos will be the exclusive photographer(s) retained by the Clients for the purpose of photographing the event. Family and friends of the Clients are free to photograph the event as long as they will not interfere with the photographer’s duties and will not interfere with poses arranged by photographer.

SHOOTING TIME/ADDITIONS: The photography schedule and selected methodology are designed to accomplish the goals and wishes of the CLIENT in a manner enjoyed by all parties. CLIENT and PHOTOGRAPHER agree that cheerful cooperation and punctuality are therefore essential to that purpose. Shooting commences at the scheduled START TIME and stop on END TIME.
CLIENT is responsible for added production fees and expenses due to conditions imposed by CLIENT but not revealed at contract inception; e.g. travel expenses due to change of location, or additional portrait sessions.

HOUSE RULES: The photographer is limited by the guidelines of ceremony official or reception site management. CLIENT agrees to accept the technical results of their imposition on the photographer. Negotiation with the officials for moderation of guidelines is CLIENT’s responsibility; PHOTOGRAPHER will offer technical recommendations only.

EXHIBITION: CLIENT grants PHOTOGRAPHER permission to display images as an example of PHOTOGRAPHER’s work. The photographs may be used for editorial, trade, internet or advertising purposes. The PHOTOGRAPHER may slightly alter photos (remove blemishes), but will NOT alter them in any unlawful manner.

LIMIT OF LIABILITY: In the unlikely event that the photographer is injured or becomes too ill to photograph the event, PHOTOGRAPHER will secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. PHOTOGRAPHER takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that all the photographs or negatives have been lost, stolen, or destroyed for reasons within or beyond PHOTOGRAPHER’s control, PHOTOGRAPHER liability is limited to the return of all payments received for the event package. The limit of liability for a partial loss of originals shall be a prorated amount of the package selected, based on the percentage of originals lost.

TRAVEL: There may be an additional travel charge added to an event which are or become out of the PHOTOGRAPHER’S area (an approximate 50km radius of Centurion). Arrangements should be discussed with the PHOTOGRAPHER prior to booking your event date. Overnight accommodations will be charged to the client if necessary.

COVERAGE: It is the Client’s responsibility to make sure that the event and its members are on time and the necessary members are available when requested for a photograph. Rixile Photos will honour any requested photographs.

WEATHER: Necessary changes will be made due to any weather disturbances.

COPYRIGHT: All original images remain the property of Rixile Photos. Rixile Photos keeps all images. Permission is granted for all images to be displayed and used by Rixile Photos for advertising, Competition, internet purposes and other purposes. Upon full payment, the client is granted a Non-exclusive unlimited license to use the digital images for their own non-commercial purposes, such as printing, electronic messaging, exchange with friends and relatives, or display on the internet.

DESCRIPTION OF SERVICES: Rixile Photos will provide high quality photographic services for the event(s) described on page 1. Unless otherwise noted, we will provide one professional photographer to take photographs using digital camera equipment, producing “digital images” in high-resolution .JPG format. In addition to the primary photographer assigned, Rixile photos mat use additional photographers and/or assistants at its discretion. Digital images will be delivered to a client via DVD, unless otherwise agreed.

COOPERATION & AVAILABILITY: The parties agree to cheerful cooperation for the best possible results. In order to help achieve the best result possible at large events, either the Client or their designee must point out individuals/groups that are important to have photographed.

DESIRED SCENES: The Client will provide Rixile Photos with a list of suggested photographs that they desire in advance. While every attempt is made to accommodate the client’s desired list of photographs and create the best images possible, no particular image is guaranteed. Rixile Photos is equipped to handle most low-light situations. In situations where flash photography is prohibited or is deemed to be unsafe, the client agrees to accept the digital images as is, given the technical limitations of low-light photography.

HOUSE RULES: The RIXILE PHOTOS PHOTOGRAPHERS are limited by the guidelines and policies of the ceremony official and the reception site management. The CLIENT agrees to accept the technical results of the imposition of thee house rules on the RIXILE PHOTOS PHOTOGRAPHERS. Negotiation with the officials for moderation of guidelines/policies is the sole responsibility of the CLIENT; the RIXILE PHOTOS PHOTOGRAPHERS will offer technical recommendations only.

MISS PHOTOGRAPHIC OPPORTUNITY: The CLIENT agrees to hold the RIXILE PHOTOS PHOTOGRAPHERS not liable for any missed photographic opportunities due to key individuals’ failure to be present or to cooperate during photography sessions, or due to details not revealed to the RIXILE PHOTOS PHOTOGRAPHERS. Every possible care will be taken to produce photographs of all important and special events during the wedding. However, and as the event is an uncontrolled environment, the RIXILE PHOTOS PHOTOGRAPHERS cannot place an unconditional guarantee on the above. The RIXILE PHOTOS PHOTOGRAPHERS will not be held responsible for any unsatisfactory photographs due to guest’s (or any other) flash or other photographic equipment interference; or any other unsatisfactory photographs due to any other cause within or outside of the RIXILE PHOTOS PHOTOGRAPHERS’s control.

The RIXILE PHOTOS PHOTOGRAPHERS will not tolerate verbally or physically abusive behaviour, nor will he share time or compete with guest photographers for the attention of the subjects. Unchecked guest conduct that interferes with photography may seriously affect the quality of the photographs taken, increase the number of time photos must be re-taken, and/ or completely eliminate the possibility to capture the moment. If, after discussing the situation with the CLIENT, and the CLIENT is unable to control the conduct of their guests , and such conduct results in an unacceptable measure of interference, or if guest conduct results in the RIXILE PHOTOS PHOTOGRAHERS suffering equipment loss or damage, the RIXILE PHOTOS PHOTOGRAPHERS may be forced to terminate services. The CLIENT understands that in such an event, no refund will be provided. In the event of equipment loss or damage resulting from guest misconduct, the CLIENT further understands they may be held liable for recovery of any costs incurred as a result of such equipment loss or damage.

SAMPLE CD DELIVERY: After the wedding, RIXILE PHOTOS will provide the CLIENT with a watermarked low resolution sample CD. This sample CD will contain all photographs (in both colour and Black & white) taken at the event. All photographs will have a watermark embedded, prohibiting unauthorised use. The CLIENT should as soon as possible provide RIXILE PHOTOS with a list of desired images to be printed, enlarged and/ or digitally manipulated (corresponding to the amount of prints agreed upon in this contract). The list should specify which images should be in colour, black & white or sepia. Printing of photographs cannot commence prior to RIXILE PHOTOS’s receipt of this list. The CLIENT agrees if the balance is not paid on initial sample CD delivery, RIXILE PHOTOS will NOT make a final delivery of selected prints, incurring no liability to RIXILE PHOTOS and resulting in loss of reservation deposit bt CLIENT.

90 MINUTES WINDOW: The bride and/or groom agree to set aside at least 30 minutes before the commencement of the wedding ceremony and a 60 minutes time afterward for photographs that cannot be obtained during the ceremony or reception. The 60 minutes following the ceremony includes group photographs. If either the bride’s or groom’s late arrival (or any other reason outside of the photographer’s control) prevents this 90 minutes window from occurring, RIXILE PHOTOS shall not be held liable for failure to take desired photographs.

PERFOMANCE: The performance of this contract on behalf of RIXILE PHOTOS shall be contingent upon acts of God, floods, fire, warfare, government laws or regulations, electrical failure, strikes by suppliers, and/or conditions beyond its control.

AMENDMENTS: This contract has been freely negotiated and shall be recognised as the entirely of the agreement. Only those change or modifications specifically placed in writing, attached, dated and signed by the CLIENT and RIXILE PHOTOS at the time of acceptance of this contract shall be recognised as amendments to this contract.
